This Privacy Policy describes how NextWave Tech Inc. ("NextWave Tech", "we", "us", or "our") collects, uses, and discloses personal information in connection with the TextMint product and the textmint.ai website (together, the "Service").
NextWave Tech Inc. is incorporated in Alberta, Canada (Corporate Access Number 2026986097, CRA Business Number 771764164), with its registered office at 203-8500 19 Avenue, Calgary, Alberta T2A 7W8, Canada.
1. Information we collect
We collect personal information that you provide directly to us, including:
- Account & contact details: name, business name, email address, mobile phone number.
- Consent records: the timestamp, IP address, user agent, and source of any consent you give us (for example, opting in to SMS or email updates).
- Service content: messages you send to or receive from the TextMint AI agent, lists you upload or connect, and configuration you provide.
- Usage information: log data, device identifiers, and analytics about how you use the Service.
2. How we use information
We use personal information to:
- Provide, operate, and improve the Service.
- Send service messages and product updates. We only use channels where you have given consent (and only where required by law).
- Comply with legal obligations under Canadian Anti-Spam Legislation (CASL), Canadian privacy law (PIPEDA), and applicable U.S. laws including the TCPA.
- Maintain audit records of consent for compliance and dispute resolution.
3. SMS messaging
If you opt in to receive SMS messages from TextMint, message frequency varies (typically 2 to 6 messages per month). Message and data rates may apply. You can opt out at any time by replying STOP. For help, reply HELP or contact us at the address below. We do not share or sell mobile phone numbers or SMS opt-in data to third parties or affiliates for marketing purposes.
4. WhatsApp messaging
TextMint sends and receives messages over WhatsApp using the WhatsApp Business Platform (the WhatsApp Business and Cloud APIs) provided by Meta Platforms. When you interact with the Service over WhatsApp, your mobile phone number, your WhatsApp profile name, and the content of your messages are transmitted to and processed by Meta in order to deliver those messages. Meta's handling of this information is governed by Meta's own privacy and messaging policies.
If you are a business that connects your own WhatsApp Business Account to TextMint (for example, through Meta's Embedded Signup), you authorize us to access and manage that account on your behalf so that we can send and receive messages and create and manage message templates for your business. We access this information only to provide the Service to you. We do not sell it, and we do not use it for advertising or for any purpose other than operating the Service as described in this policy. You can disconnect your WhatsApp Business Account at any time, which revokes our access.
5. Service providers and AI processing
We use trusted service providers to operate the Service, including hosting and infrastructure providers (Cloudflare, Inc., Supabase, Inc., and Trigger.dev), our SMS provider (Telnyx LLC), our email provider (Twilio SendGrid), and Meta Platforms Ireland Limited (which provides the WhatsApp Business Platform). These providers process information on our behalf under written agreements that restrict their use of personal information.
To operate the TextMint AI assistant, the content of your messages and related information is sent to and processed by third-party artificial-intelligence providers that generate responses on our behalf. These providers currently include DeepSeek (Hangzhou DeepSeek Artificial Intelligence Co., Ltd.), Anthropic, PBC, and OpenAI, L.L.C. We use these providers solely to provide the Service, and their handling of this information is also subject to their own privacy policies. Because one of these providers, DeepSeek, operates in China, message content processed by it may be transferred to and stored in China; see "International transfers" below.
6. International transfers
Personal information may be processed in Canada, the United States, China, and other jurisdictions where our service providers operate. In particular, message content processed by our AI provider DeepSeek may be transferred to and stored in China, which may not offer the same level of data protection as your home jurisdiction. Where required, we use appropriate contractual safeguards.
7. Retention
We retain personal information for as long as necessary to provide the Service and meet legal obligations, including consent records required under CASL, which we keep for at least three (3) years after the consent expires or is withdrawn.
8. Your rights
Depending on where you live, you may have the right to access, correct, delete, or export your personal information, and to withdraw consent at any time. To exercise any of these rights, email us at privacy@textmint.ai.
9. Children
The Service is not directed to individuals under the age of 16, and we do not knowingly collect personal information from children.
10. Changes to this policy
We may update this Privacy Policy from time to time. The "Last updated" date at the top reflects the most recent revision. We will provide notice of material changes through the Service or by email.
